Terms of service

These terms are an agreement between you and Handler Labs LLC(“Kinclaim”, “we”, “us”) governing your use of https://getkinclaim.com and the documents it produces. By using the service you agree to them.

1. What the service is

Kinclaim is self-help software. It asks you questions, applies published statutory rules to your answers, and produces completed legal forms and instructions for you to review, sign and use yourself.

Kinclaim is not a law firm and is not a substitute for an attorney. We provide self-help software and statutory forms. We cannot give legal advice or tell you what to do in your particular situation, and using this site does not create an attorney-client relationship.

We do not file anything on your behalf, do not appear before any court, do not hold or transfer any funds or property, and do not represent you in any capacity.

2. Eligibility to use it

You must be at least 18 and legally able to enter a contract. You must be acting for yourself or in a capacity that entitles you to act, as an heir, successor, surviving spouse, or nominated representative of the estate. You may not use the service to collect property you have no legal right to.

3. Your responsibilities

  • Accuracy. Everything you enter must be true and complete to the best of your knowledge. We cannot verify what you tell us and do not attempt to.
  • Review before signing. You must read every document in full before signing it. The documents are sworn statements.
  • Your own judgment. You are responsible for deciding whether the affidavit route is right for your situation, and for obtaining legal advice where you are unsure.
  • Compliance.You are responsible for satisfying your state’s requirements for signing, notarization, witnessing, filing and service.

4. What we provide, and what we don’t promise

We take real care over the accuracy of the statutory rules we publish. See how we verify state law, and we state on each state page the date we last verified it. But law changes, courts and institutions apply it differently in practice, and no automated process is infallible.

Accordingly the service is provided “as is”. We do not warrant that any document will be accepted by any particular bank, agency, court or other institution, that any statutory figure is current at the moment you read it, or that the affidavit route is the correct choice for your circumstances.

5. Payment

Prices are shown before purchase and charged once. There is no subscription and nothing recurring. Payment is processed by Stripe; we never receive your card details. Prices are in US dollars and exclude any tax that may apply where you are.

6. Refunds

You may request a full refund within 30 days of purchase, for any reason, including after downloading your documents. See the refund policy.

7. Your content and your documents

The information you enter remains yours. You grant us only the license needed to store and process it in order to produce your documents and support you.

The completed documents we generate are yours to use for settling the estate they relate to. Our underlying templates, software, rules database, and site content remain our property. You may not resell, redistribute, or build a competing service from them, and you may not scrape the site or its state rules.

8. Acceptable use

You agree not to:

  • use the service to obtain property you are not legally entitled to, or to make a statement you know to be false;
  • attempt to gain access to another user’s matter or to our systems;
  • scrape, bulk-download or systematically copy our state rules or content;
  • resell or sublicense the service or its output.

9. Limitation of liability

To the maximum extent the law allows, our total liability to you for any claim arising out of the service is limited to the amount you paid us for it. We are not liable for indirect, incidental, special or consequential damages, for lost property or lost inheritance, or for the acts of any bank, court, agency or other third party.

Nothing here limits liability that cannot lawfully be limited, including for fraud. Some states do not allow certain exclusions, in which case those exclusions do not apply to you.

10. Indemnity

You agree to indemnify us against claims arising from information you supplied that was untrue, from your use of a document in a way these terms do not permit, or from your breach of these terms.

11. Changes to the service and these terms

We may change the service and these terms. If a change materially affects your rights we will update the date above and, where you have an active matter, email you. Continuing to use the service after a change means you accept it.

12. Termination

You can stop using the service at any time and ask us to delete your data. We may suspend access where we reasonably believe the service is being used unlawfully or in breach of these terms.

13. Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before starting formal proceedings, please contact us at support@getkinclaim.com, in practice, almost everything is resolved that way, usually with a refund.
